Rental terms and conditions

Version in force. These terms apply from the moment they are published online. The version applicable to a rental is the one accepted on the day of booking.

Article 1 — Identification of the lessor

ICI C'EST PERMIS, Société par actions simplifiée unipersonnelle (SASU) with share capital of 100 €, registered office at 13 boulevard d'Aulnay, 93250 Villemomble, entered in the RCS (French trade and companies register) of Bobigny under number 934 275 819, represented by its president Maeva Katamba Kware, hereinafter “the Lessor”.

Article 2 — Purpose

The Lessor makes available to the hirer, without a driver, a vehicle fitted with dual controls, intended principally for sitting the practical driving test as an independent candidate, for supervised driving practice or for the activity of an independent driving instructor.

The Lessor is not a driving school: it provides no driving tuition, issues no educational assessment and does not register the hirer for the test on their behalf.

Article 3 — Conditions to be met

3.1 The hirer

The hirer must be at least 18 years old and must produce, when the vehicle is handed over:

• Valid proof of identity
• Valid NEPH number (French candidate registration number)
• Proof of address less than 3 months old
• The accompanying driver's licence (held for at least 5 years)
• A bank card in the hirer's name for the deposit pre-authorisation

3.2 The accompanying driver

The vehicle may only be driven with a person in the front passenger seat who has held a valid category B licence (permis B) for more than 5 years and whose licence has not been suspended, withheld or cancelled in the last five years. The accompanying driver is either brought along by the hirer or provided by the Lessor under the exam package or the corresponding option.

3.3 Refusal to hand the vehicle over

The Lessor reserves the right to refuse to hand the vehicle over if any of these conditions is not met, if the documents produced are incomplete or doubtful, or if the hirer or the accompanying driver shows clear signs of being unfit to drive. In such a case, the sums paid remain due to the Lessor.

Article 4 — Order, prices and payment

4.1 Placing the order

The hirer puts their order together on the website, configuring one or more bookings and adding them to their basket. They then enter their contact details, accept these terms and proceed to payment. The order is firm and final as soon as it is paid in full, subject to the confirmation of availability provided for in article 4.3.

4.2 Prices and means of payment

Prices are stated in euros, all taxes included. They cover comprehensive insurance and 0 km roadside assistance, as well as the mileage set out in article 6. They exclude the fuel or electricity used, options not taken and the charges listed in article 10.

Payment is made online, on a secure payment page operated by SumUp. At no point does the Lessor have access to the hirer's card details. Means accepted: Bank card, Apple Pay, Google Pay. An invoice is sent to the hirer.

4.3 Confirmation of availability and refund

As the Lessor's fleet is limited, the availability of the vehicle on the date requested is checked after the order. The Lessor confirms that availability to the hirer within 24 hours.

If the vehicle ordered is not available, the Lessor offers the hirer a vehicle of an equivalent category or another date. Failing agreement, the order is cancelled and refunded in full within 14 days, with no charge whatsoever retained.

Article 5 — Handover and return

The vehicle is handed over at the Lessor's branch, 13 boulevard d'Aulnay, 93250 Villemomble, or delivered to the address agreed according to the zone chosen:

• Collection at the branch — free
• Seine-Saint-Denis (93) — €29
• Inner ring (75, 92, 94) — €39
• Rest of Île-de-France (77, 78, 91, 95) — €49

A joint condition report is drawn up at handover and on return. Failing any written reservation by the hirer at handover, the vehicle is deemed to have been handed over in good condition. The vehicle must be returned on the date, at the time and at the place agreed. Every hour of delay begun is charged at €25.

Article 6 — Mileage, fuel and charging

100 kilometres are included per rental day and 50 kilometres for an exam package or an hourly slot. Each extra kilometre is charged at €0.35.

The vehicle is handed over with a fuel level or state of charge recorded in the condition report; it must be returned at the same level. Failing that, the Lessor charges for the difference at cost price plus a service charge of €30.

Article 7 — Use of the vehicle

It is strictly forbidden:

• to drive without an accompanying driver meeting the conditions of article 3.2;
• to entrust the vehicle to a person not declared in the contract;
• to drive under the influence of alcohol, narcotics or medicines incompatible with driving;
• to leave French territory without the Lessor's prior written agreement;
• to use the vehicle for the paid carriage of persons or goods, for competition, for testing or for towing;
• to use the vehicle to give paid driving tuition without holding the teaching authorisation required by the French code de la route (Highway Code);
• to overload the vehicle or to drive off roads open to public traffic;
• to smoke or vape on board.

Any breach of these prohibitions terminates the contract immediately, voids the insurance cover and leaves the hirer fully and entirely liable.

Article 8 — Insurance and excess

The vehicle is insured by the Lessor with À COMPLÉTER (policy no. À COMPLÉTER) under compulsory third-party liability cover and comprehensive cover, including roadside assistance from the very first kilometre.

In the event of an at-fault claim, theft or damage with no identified third party, an excess remains payable by the hirer:

• Manual city car: €800
• Automatic electric: €1,500
• Premium electric: €2,500

The hirer may reduce this excess by taking, at the time of booking, one of the following options:

• Peace of mind — €9 per day or €15 per exam package or slot: your excess is halved in the event of an at-fault claim.
• Zero worries — €19 per day or €25 per exam package or slot: excess brought down to €0: nothing at all is left for you to pay in the event of an at-fault claim.

These options cover neither damage resulting from one of the breaches listed in article 7, nor the loss of the vehicle's keys or documents, nor damage to the tyres, the underbody and the passenger compartment, which remain entirely payable by the hirer.

Article 9 — Deposit

A bank card pre-authorisation is taken when the vehicle is handed over, by way of security, for an amount of €800 to €2,500 depending on the vehicle. This pre-authorisation is not charged. It is released once the vehicle has been returned and no damage, penalty notice or outstanding charge has been found, and within 30 days at the latest.

Article 10 — Charges that may be invoiced

• Extra kilometre: €0.35
• Missing fuel or charge: €30 service charge, on top of the difference at cost price
• Late return: €25 per hour begun
• Vehicle returned dirty: €60
• Penalty notices: the Lessor names the driver to the Agence nationale de traitement automatisé des infractions (the French traffic offence agency), in accordance with article L. 121-6 of the code de la route, and charges an administrative handling fee

Article 11 — Accident, breakdown, theft

Every accident, even without a third party, must be reported to the Lessor as soon as possible and within 24 hours at the latest, and be recorded on a completed and signed accident report form. Any theft or act of vandalism must also be reported to the police, and the receipt handed to the Lessor. Failing that, the hirer bears the full financial consequences.

Should the vehicle be off the road for a reason attributable to the Lessor before a test, the Lessor undertakes to offer a replacement vehicle of an equivalent category or, failing that, to refund the sums paid in full. That obligation does not extend to indirect loss, in particular the cost of registering for the test.

Article 12 — Changes and cancellation

The hirer may cancel or change their order free of charge up to 48 hours before the scheduled pick-up time; the refund is made within 14 days to the means of payment used. After that, 50 % of the amount paid is retained by the Lessor. Should the hirer fail to turn up, the whole amount remains due to the Lessor.

Should the practical test be postponed or cancelled by the authorities, the booking is moved at no charge on production of the evidence, subject to availability.

Article 13 — Right of withdrawal

In accordance with point 12 of article L. 221-28 of the code de la consommation (French Consumer Code), the right of withdrawal does not apply to contracts for the hire of vehicles to be supplied on a given date or during a given period. The cancellation terms set out in article 12 apply instead.

Article 14 — Personal data

The data processing carried out for the booking and the rental is described in the privacy policy.

Article 15 — Complaints and mediation

Any complaint must be sent in writing to contact@ici-cestpermis.com or by post to the registered office. The Lessor undertakes to reply within 30 days.

Failing an amicable solution, the consumer may refer the matter free of charge to the consumer ombudsman with jurisdiction over the Lessor, in accordance with article L. 612-1 of the code de la consommation. That ombudsman's details are provided on simple request to contact@ici-cestpermis.com. The consumer may also use the European online dispute resolution platform.

Article 16 — Governing law

These terms are governed by French law. In the event of a dispute with a consumer, the competent courts are those of the defendant's place of residence or of the place where the service is performed, at the claimant's choice.
